Terms of Use

1. Health disclaimer — please read

CaloriePace is not a medical device and does not provide medical, nutritional, or psychological advice. The calorie targets, burn estimates, and other figures it shows are estimates for general informational and educational purposes only. They may be inaccurate and are not a substitute for professional advice.

• Consult a qualified healthcare professional before starting any weight-loss, diet, or exercise program, especially if you have a medical condition, are pregnant or nursing, or take medication.
• Do not use the Application to set or pursue unsafe calorie targets. Eating too little can be harmful.
• If you are struggling with disordered eating or your mental health, please stop and reach out to a doctor or mental-health professional. In a crisis, contact your local emergency services.

You use the Application and rely on its outputs at your own risk.

2. Third-party nutrition data

Food and product information is retrieved from third-party sources — USDA FoodData Central and Open Food Facts — when you search or scan. We do not control and cannot guarantee the accuracy, completeness, or timeliness of that data. We accept no liability for any loss arising from your reliance on third-party nutrition information.

3. Eligibility

You must be at least 17 years old to use the Application. By using it, you represent that you meet this requirement and are legally permitted to use it in your jurisdiction.

4. License

Subject to your compliance with these Terms and Apple's EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on Apple devices you own or control, for your personal use. You may not reproduce, distribute, modify, create derivative works from, reverse-engineer, decompile, disassemble, or attempt to extract the source code of the Application, except to the extent applicable law expressly permits.

5. Intellectual property

We retain all intellectual-property rights in the Application, including its code, design, trademarks, logos, and branding. Nothing in these Terms grants you any right to use our trademarks, logos, or branding.

6. In-app purchase

The Application offers a one-time, non-consumable in-app purchase ("CaloriePace Pro") that unlocks additional features. It is a one-time purchase, not a subscription. All payments are processed by Apple under your App Store account and Apple's terms; we do not process or receive your payment details. We may change the features offered or introduce new paid features in the future; any charges will be clearly disclosed before purchase.

7. Your responsibilities

You are responsible for the security of your device and your access to the Application. Some features require an internet connection; we are not responsible if the Application does not work fully due to lack of connectivity. You are responsible for any data or roaming charges your carrier applies, and for keeping your device charged and updated. We advise against jailbreaking or rooting your device.

8. Updates and availability

We may update the Application, and the operating-system requirements may change; you may need to install updates to keep using it. We do not guarantee continued updates or compatibility with every OS version, and we may stop providing the Application at any time. On termination, your license ends and you must stop using and delete the Application.

9. Termination

We may suspend or terminate your access if you materially breach these Terms. Where the breach can be cured, we will give you notice and 14 days to cure it. We may act immediately, without notice, if you violate applicable law or infringe intellectual-property rights. Nothing here limits any statutory rights you have that cannot lawfully be excluded.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data loss, arising from your use of the Application. Our total liability for any claim shall not exceed the amount you paid us for the CaloriePace Pro one-time unlock (if any). Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under applicable law. These limits do not affect your mandatory consumer-protection rights.

11. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold us harmless from claims, liabilities, damages, losses, and reasonable legal fees arising from your breach of these Terms or your misuse of the Application. This does not apply to claims arising from our own negligence, breach, or violation of law. Where consumer law restricts such indemnities, this clause is limited accordingly.

12. Governing law and jurisdiction

These Terms are governed by the laws of the State of California, United States, excluding its conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence provide otherwise. Any dispute will be subject to the courts located in California, unless mandatory law grants you the right to bring a claim in the courts of your home jurisdiction.

13. Severability; entire agreement

If any provision of these Terms is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions stay in effect. These Terms, together with the Privacy Policy and Apple's EULA, constitute the entire agreement between you and us regarding the Application.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new effective date. Continued use after an update constitutes acceptance where permitted by law.
